Customer is the registered legal owner of the vehicle(s) and has authority to enter into this agreement or has been duly authorized by the legal owner of vehicle(s) to enter into this agreement. 2. The carrier and driver jointly and separately are authorized to operate and transport his/her or their motor vehicle between its pick up location and the destination set forth on this shipping order-bill of lading. 3. Classic Auto Express is a registered, licensed and bonded property broker. Classic Auto Express is responsible for booking the shipment of cars with licensed and insured Motor Carriers, who handle their own damage claims in a professional manner. Processing damage claims may take a few weeks, since the drivers must return to their terminals with the original Bill of Lading condition reports. 4. The customer shall disarm any vehicle alarm system and provide Motor Carrier with any tools or keys necessary to disarm system if activated. If the alarm system is activated during the transport of the vehicle, the motor carrier may deactivate the alarm system by any means that it or the transport driver deems reasonable and effective. Customer shall prepare the vehicle(s) for transport by removing or properly securing all batteries, loose parts, fragile or protruding accessories, low hang spoilers, antennas and other similar items. Customer releases any claims for damages that are caused by customers failure to fulfill these obligations. 5.All payments for transport must be in the form of a cashiers' check or cash on delivery. The customer (Owner of vehicle) agrees that if the payment cannot be made by cashiers' check the vehicle will be stored at customers expense. Should the customer, for any reason, be unable to accept delivery, the vehicle will be placed in storage. Any and all storage and/or delivery costs will be the responsibility of the customer. 6. Customer shall remove all detachable personal belongings from the vehicle(s). The motor carrier may impose additional fees, in its sole discretion, for the transport of contents left in a vehicle. In no event, however will Classic Auto Express be responsible for the safe transport of any such contents. 7. All delivery dates and times are only estimates. Classic Auto Express does not agree to transport the vehicle(s) in time for any particular market or event and will not be responsible for any loss or damage resulting from any delay. No Express or implied warranties are made with respect to delivery times or dates. 8.Classic Auto Express or its carriers will not be responsible for acts of god (earthquakes, floods, fire, tornado, sandstorms, or hail storms), damage due to flying objects from the sky or road during transport, or any vandalism. The customer must maintain his/her insurance for this purpose. 9. Trucking damage claims, although rare, are the responsibility of the assigned carrier who is required by law to carry a minimum of 3/4 (three quarters) of a million dollars public liability. All claims must be noted and signed for at time of delivery, and submitted in writing to the assigned carrier within the terms of the carriers bill of lading. Classic Auto Express will share the carrier insurance policy information upon request but is not the entity responsible for any damages. The assigned carrier is solely responsible for the condition of your vehicle while it is in his or hers possession. 10. Any deposit made by customer shall be retained immediately by Classic Auto Express based on the completion of the transport of the vehicle unless otherwise canceled by the customer. In the event a carrier has been assigned to the transport the full deposit may be retained and considered earned by Classic Auto Express. Customer may cancel this agreement at any time prior to a carrier being assigned to transport said vehicle at no cost. 11. A deposit shall be paid when vehicle is loaded onto a carrier and shall not be refunded once customer's vehicle has been loaded onto a carrier. 12.The entire amount of the transport charge is due and payable without discount upon tender of the vehicle regardless of the loss of, or damage to, the vehicle at any stage of the transport. An additional charge of $200.00 will be assessed if the vehicle becomes inoperative for any reason during transport. An oversize vehicle fee of $300.00 will be imposed unless such vehicle has been per-approved and disclosed prior to transport. 13. Any claim or controversy arising from this agreement, or performance or breach thereof, shall be subject to the jurisdiction of Gem County, Idaho. The customer must specifically waive any right to jurisdiction of this matter at any other location. Classic Auto Express can only be liable up to the amount of the deposit in the quotation furnished to the customer. Under no circumstances can Classic Auto Express be held liable for damages caused by the designated carrier. 14. If the assigned driver is unable to pick up a customers car at their designated pickup address due to traffic, street, or legal restrictions, the customer must meet the driver at a nearby location to load the car. 15. If Classic Auto Express provides the customer with a free instant online auto transport quote, this price will be for a standard 4-door automobile. This base quote is then modified by the actual type and description of the vehicle you are having transported to arrive at your full quote. Since we also offer express pickup services and other auto transport services, special requests by the customer can affect increases or decreases in your final quote for auto transport. |
